Article published in Times Of India, April 7, 2011

MUMBAI: Residents of Juhu are celebrating their victory after they were allowed access to a privately owned recreation ground, but they are in a minority. At Marine Drive, residents of F-Road have been protesting the alleged misuse of a green lung—which has been leased to a cooperative housing society by the collector—with little success. The open space has been reserved as a recreation ground, but angry locals have accused the management of Shri Niketan Co-operative Housing Society (CHS) of using the land for commercial purposes such as hosting wedding receptions.

Over 800 families from 26 buildings expressed their willingness to launch a signature campaign demanding access to the ground. As of now, the gates of the garden are closed, say activists, adding that there is no board mentioning who owns the ground. The plot, measuring 25,000 sq ft, is on collector`s land and was given on lease to Shri Niketan CHS for 999 years.

Ashish Shah, a member of the Marine Drive Residents` Action Group (MDRAG), which has taken up cudgels on behalf of citizens, said: "Our fight isn`t with the owners, but with the BMC and the collector. The collector has powers to revoke the lease. The garden has been converted into a decorator`s godown. CHS claims to have taken permission from the collector to conduct 15 weddings on the RG plot annually. " He added that the housing society has also violated other conditions by constructing a bathrom and changing room for the bride and groom.

Another F-Road resident Nikhil Banker, said: "The society charges for weddings stating that it will use the money to maintain the plot. So far nothing has been done."

But Ramesh Gopalka, the joint secretary of Shri Niketan CHS refuted the claims. "We have all the valid documents to prove that the ground`s use is legal and that Shri Niketan CHS is the owner. We have a lease agreement of 999 years. As this is not a public garden due permission is needed from the collector if citizens wish to have access to it." He added that there is a children`s corner in the garden, which is open to kids under the age of 12.

Collector C K Oak said, "I visited the site 15 days ago. I will study the lease agreement and if there are any violations, I will initiate action. Residents were to submit documents to support their claim, but they have not done so yet."

Residents living in the proximity of Marine Drive are known to enjoy fresh air. But recently, a few of them have been complaining about the stench they get the moment they open the window.
For the past one week, every morning some people burn garbage sending unbearable stench for the residents who live there. Most of it is plastic and rubber which burns for two to three hours on a daily basis. Burning garbage is an offence as per BMC cleanliness laws.
“You cannot open the window. Every morning they do the same thing. The burning happens for long hours,” said Anand Shah of Badrikeshwar building, which is nearest to the track and close to Hindi Vidya Bhavan School which is most affected.
Another resident, Nikhil Banker, living at Patan Jain Mandal building said, “They have kept a permanent tray where they do this burning. The contractors appointed by the railway collect it and burn everyday. Last time I caught them but nothing much changed even after the complaints. Since our road is on the border of two wards, we are tossed like a ball.”
Ashish Shah, another resident of Badri Keshwar building said, “These guys have made a permanent dump place there. They sort out the garbage and whatever is not useful burn it over there instead of throwing it in a dustbin. We have even shown the RPF guys where the garbage is burnt. They stopped burning for a week but they are back. Sometimes the engineering staff of the railways burn the discarded stuff. How many times do we keep complaining?”
When contacted, Sharat Chandrayan, chief spokesperson of the Western Railway said, “I do not know of any burning happening. We have not received any complain either. Once we do, we will take action.”
The deputy municipal commissioner was not available for comment.

Mumbai Mirror Article regarding the CRZ plan to save open spaces

Ramesh’s CRZ plan to save open spaces

Ministry of Environment and Forests wants all open spaces in Mumbai falling under CRZ II to be marked as no-development zones
Ravikiran Deshmukh
Posted On Wednesday, October 06, 2010 at 02:14:54 AM
Even as his staunch opposition to the proposed Navi Mumbai airport has frustrated the state government for months, Union Environment Minister Jairam Ramesh is now swooping in to save Mumbai's fast-depleting opening spaces.

In a draft notification made specifically for the city, Ramesh's ministry has decided to stop any commercial exploitation of land that falls within Coastal Regulation Zone (CRZ) II norms.

According to the notification, issued on September 15, all such areas will be reassigned as No-Development Zones, thereby barring construction even on all parks, gardens and playgrounds indicated in the development plans within CRZ II.

While the total area in this plan has not yet been ascertained, it will cover all land "up to or close to the shoreline" that already has drainage, approach roads, water supply, sewerage mains and other infrastructure, from the southern tip in Colaba to Gorai in the west and Mankhurd in the east.

This decision, sent to the state's Urban Development (UD) department and passed on to the Brihanmumbai Municipal Corporation (BMC), will leave no room for the corporation's controversial caretaker policy that permits private parties to build clubhouses, restaurants and other recreation amenities on parts of CRZ II plots.

Activists have long alleged that once builders get a toe-hold on open spaces through the policy, it is only a matter of time before they begin to exploit the entire expanse for construction.

Environment Minister Jairam Ramesh
Responding to the Environment Ministry's notification, the UD department and BMC have started gathering information to list the relevant open spaces.

Ashok Shintre, BMC's director, engineering services and projects, said the task would take at least a month.

"We have received the notification from the state Urban Development Department. They have asked for the number of open spaces falling under the CRZ. But the coastal stretch in the city is very long.

There are several open spaces along the coastline. We also have to categorise them as per their status. The whole exercise will take a month's time. The detailed report will be submitted to the state only after that," he said.

When contacted, Nayana Kathpalia of the NGO Citispace, which has been fighting for the green spaces, described the notification as significant. "This will act as a legal sanction for the protection of the much-needed open spaces in Mumbai. As a result, people eyeing these pieces of land will be kept away," Kathpalia said.

What is coastal regulation zone-II land

The areas that have already been developed upto or close to the shoreline. For this purpose, 'developed area' is referred to as that area within the municipal limits or in other legally designated urban areas which is already substantially built up and which has been provided with drainage and approach roads and other infrastructural facilities, such as water supply and sewerage mains.
